1. Eligibility and Account

You must be at least 18 years old to create an account. By creating an account, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@getgoodatbadminton.com if you suspect unauthorized access.

2. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Attempt to reverse-engineer, scrape, or extract data from the platform in bulk
• Upload content that is unlawful, harmful, infringing, or violates the rights of any third party
• Upload video content that you do not have the legal right to upload
• Interfere with the integrity or performance of the Service or its infrastructure
• Share your account or resell access to the Service
• Use the Service to build a competing product without our written consent
• Use the Service to harass, surveil, or otherwise harm others

We reserve the right to suspend or terminate accounts that violate these rules.

3. Beta Program

The Service is currently offered in a beta phase. During beta, features may be incomplete, changed, or removed without notice. Beta access does not guarantee continued availability of any specific feature.

4. Your Content and Responsibility for Video

You retain ownership of all match data, annotations, and video content you upload to the Service ("Your Content").

By uploading Your Content, you represent and warrant that:

• You own Your Content or have all rights, licenses, and consents necessary to upload it
• For any identifiable individuals visible or audible in your video, you have obtained all consents required under applicable law
• For any minors visible in your video, you have obtained verifiable consent from their parent or legal guardian
• Your Content does not infringe any third party's rights, including privacy, publicity, intellectual property, or contractual rights
• Your Content complies with the rules of any venue, league, or organization where the video was recorded

You are solely responsible for Your Content and for any consequences of uploading it. You agree to indemnify and hold us harmless from any claim brought by a third party arising out of Your Content, including claims by individuals who appear in your videos.

If a person appearing in a video you uploaded contacts us and requests removal, we may remove or restrict access to that video at our discretion.

5. License to Us

By uploading Your Content, you grant GGAB a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, analyze, modify for technical purposes such as transcoding, and create derived data and analytics from Your Content solely to:

• Operate, provide, and maintain the Service for you
• Generate insights, analytics, and tracking results for you
• Train, develop, and improve our own machine learning models that power the Service's tracking and analytical features
• Provide customer support
• Investigate suspected violations of these Terms
• Comply with legal obligations

This license ends when you delete Your Content or your account, except that we may retain Your Content for a short period in backups, and machine learning models trained before deletion retain the patterns they have learned. We will not use Your Content in any new training runs after you delete it.

We do not sell Your Content or share it with third parties for advertising. Our use of third-party processors is described in our Privacy Policy.

6. Subscription Plans and Pricing

GGAB currently offers the following plans:

• Beta — $11/month USD: Full access to core features during the beta period at an introductory rate.
• Pro — $28/month USD: Full access including advanced analytics, AI-powered insights, and feature releases at general availability.

If you start an active Beta-tier subscription before we change the price, you will continue to be charged at your original Beta rate for as long as that subscription remains continuously active. If you cancel, lapse, or change your plan, the Beta rate is no longer guaranteed. We may discontinue the Beta tier with at least 30 days' notice.

Prices are in USD and exclusive of applicable taxes, which may be added at checkout.

7. Payment and Billing

Subscriptions are billed monthly in advance through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Failed payments may result in temporary suspension of your account.

8. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period; you retain access until then. We do not provide prorated refunds for partial billing periods. If you believe you were charged in error, contact us within 14 days of the charge.

9. Account Termination and Data Export

You may terminate your account at any time. We may also suspend or terminate your account for violation of these Terms, non-payment, or where required by law. Upon termination, you may request an export of your data within 30 days. After that period, we may delete your data from our active systems. Some data may persist in backups and trained models as described in our Privacy Policy.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, share, and protect your information, including video content.

11. Intellectual Property

All software, design, trademarks, and content comprising the Service, excluding Your Content, are owned by or licensed to GGAB. Nothing in these Terms grants you a right to use our name, logo, or branding without our prior written consent.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the Service will be error-free, that tracking or analytical results will be accurate, or that the Service will meet your expectations.

13. Limitation of Liability

To the fullest extent permitted by law, Shan Enterprises Inc. and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claim arising under these Terms shall not exceed the greater of the amount you paid us in the 12 months preceding the claim or USD $100.

14. Indemnification

You agree to indemnify and hold harmless Shan Enterprises Inc. and its directors, officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of Your Content, your use of the Service, your breach of these Terms, or your violation of any third party's rights.

15. Governing Law and Disputes

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada. Any dispute arising from these Terms or your use of the Service shall be resolved in the courts located in Alberta, Canada, and you consent to the exclusive jurisdiction of those courts.

Nothing in this Section limits any non-waivable rights you have under the consumer protection laws of your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email at least 14 days before they take effect. Continued use of the Service after changes are effective constitutes acceptance of the revised Terms. If you do not agree, you may cancel your account before the changes take effect.
